Acceptance of these Terms of Use
These terms of use (“Terms of Use”) are entered into by and between you and My Music Workshop Inc., a California corporation (“Company,” “we,” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms of Use”), govern your access to and use of mymusicworkshop.com, including any content, functionality, and services offered on or through mymusicworkshop.com (“Website”), whether as a guest or a member.
Please read these Terms of Use carefully before you start to use the Website. By using the Website, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found at https://www.sdmusicclasses.com/privacy-policy, which is incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Website.
Enrollment and Billing
You must be at least 18 years old to enroll a student or child in My Music Workshop classes.
Your enrollment will be renewed, and your payment method will be charged automatically until the membership is canceled. You must cancel your subscription before the end of the period or before your enrollment renews to avoid being charged the class fees for the next billing period.
Cancellation
You can cancel your membership at any time by contacting us at Carole@mymusicworkshop.com or Lianna@mymusicworkshop.com. Please list the school name and student name in your cancellation email.
No Refunds
Payments are non-refundable, and refunds are not available for missed classes or if classes are canceled by the school on whose campus the class is taught. We will make every effort to offer make-up classes if a My Music Workshop class is canceled. However, we make no promise to make the class up if it is not possible to do so. We may provide a refund, prorated amount, discount, or other credit at any time, for any reason, in our discretion.
Payment Methods
You must provide us with one or more payment methods to maintain enrollment. You authorize us to process payments using any method of payment associated with your account. You are responsible for any uncollected amounts if a payment is declined or cannot be processed for insufficient funds, expiration, or other reason. We reserve the right to suspend access to your enrollment and related services until we have successfully processed a valid payment method.
You can update your Payment Methods by using the “My Account” page in the “Parents Area.” We may also update your Payment Methods using information provided by payment service providers.
Disclaimer
The materials on the Website are provided “as is” and “as available.” The Company makes no warranties, expressed or implied, that the program will be without fault and provides no warranty of any kind. The Company does not guarantee or represent that all information on its Website is accurate and without error.
Trademarks
The Company name, the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use the marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.
Intellectual Property Rights
The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, curriculum, materials, illustrations, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Feedback
You agree that any comments, feedback, ideas, reviews, or any other material contained in communication with us may be used publicly, including online, on social media, in emails, or otherwise. Any change and enhancement suggestions you make will be deemed part of our intellectual property. If and to the extent under applicable law any change or enhancement suggestion is not deemed to be our intellectual property, you assign, grant, and transfer all rights to us and waive any right to it. If and to the extent under any applicable law any wavier is not valid, you license grants an irrevocable, worldwide right and license, free of all claims and with or without modification, to use, practice, and exercise each and all such rights in the change or enhancement suggestion and in all respects to have rights as nearly identical to the rights of authorship and ownership as the law permits.
Prohibited Uses
You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:

Governing Law and Dispute Resolution
All matters arising out of or relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), will be governed by and construed in accordance with the laws of the State of California excluding its conflict of laws rules.
Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website will be instituted exclusively in the federal courts of the United States or the courts of the State of Utah, except we retain the right to bring any legal suit, action, or proceeding against you for breach of these Terms of Use in the jurisdiction of your residence or any other relevant jurisdiction. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Moreover, at Company’s sole discretion, it may require you to submit any disputes arising from these Terms of Use or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association. In that case, judgment upon any arbitral award may be entered and enforced in any court of competent jurisdiction, and this arbitration clause and any arbitration will be governed by the Federal Arbitration Act, Chapters 1 and 2, to the exclusion of state law inconsistent therewith.
Limitation on Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION OR CLAIM ACCRUES; OTHERWISE, YOU AGREE THAT THE CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Waiver
No failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising out of or related to this Agreement will operate or be construed as a waiver; nor will any single or partial exercise of any right, remedy, power, or privilege under this Agreement preclude any other or further exercise thereof, or the exercise of any other right, remedy, power, or privilege. Moreover, no waiver by the Company of any term or condition in these Terms of Use will be deemed a further or continuing waiver of the term or condition or a waiver of any other term or condition.
Severability
If any term or condition of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, then the term or condition will be eliminated or limited to the minimum extent such that the remaining provisions of these Terms of Use will continue in full force and effect.
Changes to these Terms of Use
We may revise and update these Terms of Use at any time in our sole discretion. All changes are effective immediately when we post them and apply to all access to, and use of, the Website thereafter. However, any changes to the dispute resolution provisions set out in Governing Law and Dispute Resolution will not apply to any disputes for which the parties have actual notice before the date the change is posted on the Website.
Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes. You agree to check this page from time to time so you are aware of any changes.
Entire Agreement
